Wills and Probate

The term "probate" is derived from the Latin term meaning "to prove the will". Probate refers to the process where a court oversees the administration of a deceased person's estate. The purpose of the probate process is to ensure that any final bills and expenses are paid, including any taxes owed, and any remaining assets are distributed to the beneficiaries named in a will, or if there is no will, in accordance with Texas laws governing such a situation.

For your consultation you need to bring with you any testamentary documents like a will. In the event the deceased did not leave a will, bring as much information as you can regarding their finances, assets and liabilities. Bring any deeds or title showing ownership of property. Being any information regarding retirement accounts Bring any documents regarding debt like mortgages, credit card statements, car loans, and recent tax returns.

When probate is required, the attorneys of Guest and Gray Law Firm offer experience in probate administration. Serving as the personal representative of a decedent's estate involves many fiduciary duties and responsibilities. It is important to seek the guidance and representation of an experienced Texas probate attorney. Contact Guest and Gray Law Firm for a consultation.

What if the estate requiring probate is small?

Small estates may not require probate. If the entire estate is $50,000 or less (with some exceptions), the decedent's assets may be transferred by affidavit procedure without having to go through the probate process, provided certain complex qualifications are met. Because of this complexity, it is advisable to have an attorney assist in preparing the affidavit.

At your consultation our attorneys can discuss the availability of small estate administration, whether such administration best fits your needs, and can assist you with the small estate administration process if that is the best option for you.
